Earlier last month, the US Copyright Office released its much anticipated report regarding artificial intelligence. You can find the guidance here.
Some highlights include:
Works entirely generated by artificial intelligence (AI) are not copyrightable; however, if a work contains both human-authored and AI-generated content, only the human-authored contributions are potentially copyrightable.
To that end, works that contain both human-authored and AI-generated content will be analyzed by the Copyright Office on a case-by-case basis.
Prompts, even if incredibly detailed, are not considered copyrightable works.
Using AI tools to assist (rather than substitute) for human creativity does not affect the availability of copyright protection for the AI-generated output.
