What Agreements Do You Need to Start a Publishing Company?

As an attorney who has helped publishers start companies, I thought I would list a few agreements (and a brief explanation) that you will need.


Operating Agreements


This agreement is administrative in nature for setting up your business either as an LLC or a corporation. Since each state has its own laws regarding setting up your business, contact a business attorney in your state.


Traditional/Hybrid Agreement


This is the agreement you think of when you think of a publisher. What is in the author contract? You'll want to figure out what book formats you'll publish, the payment structure (e.g., advance and royalties) and/or a fee structure for hybrids. Essentially, this agreement will detail how you operate from production to finished product and spells out the expectations of the author and your company.
